Court awards millions in medical malpractice case

No one can replace the loss of a loved one. However, when those who died may have been saved were it not for someone's negligence, families often pursue recovery for applicable financial losses in court. Far too often, such situations in Tennessee and throughout the nation involve medical malpractice. Successfully litigated cases sometimes result in multi-million dollar settlements or verdicts.

A family in another state recently accepted a court-approved $3.5 million settlement in the aftermath of their loved one's unexpected death. The decedent was the mother of two, and her family believes a misdiagnosed heart condition was to blame for their devastating loss. The woman was only age 41 when she died.

She was a dietary technician and had sought medical help when she suffered severe pain through her arm. The doctor attending to her scheduled a cardiac evaluation and another test involving a catheterization. The latter was the test that likely would have shown she was suffering from a myocardial infarction. Strangely, however, the doctor canceled the test and never rescheduled it.

The settlement is to be disbursed in various ways, including trust funds set up for the deceased mother's children. Medical malpractice is a serious issue that often involves highly emotionally charged situations where grief stricken family members want the court to hold those believed responsible for their suffering legally accountable for their negligence.
