Slip-and-fall accidents: Supermarket must pay victim $1 million

When business owners in Tennessee allow the public onto their premises, they assume responsibility for the safety of those entering their stores. Patrons who suffer injuries in slip\-and\-fall accidents or other incidents on the property may pursue recovery of damages. A serious fall can leave a victim facing mountains of medical bills and extended absences from work.

An example of such a case is a man in another state who slipped and fell in a supermarket on a day in May 2013. He filed a complaint against the company in 2014, alleging negligence in allowing unsafe conditions to exist on its property. The complaint asserted that the company failed to maintain safe access and exit, leading to his fall that resulted in serious injuries with permanent repercussions. The nature of his injuries required several surgical procedures, including spinal fusion on two levels.

The man's claim for damages totaled $1.5 million, and in 2016, an arbitrator determined that the fall victim was partially responsible for his injuries. The arbitrator found the defendant to be 75 percent liable, and ordered the property owner to pay the plaintiff $1 million. Payment was delayed because of a bankruptcy filing in 2015 by the parent company of the supermarket.

The plaintiff's legal counsel reported that the two parties had since adjusted the amount in an amicable manner. Tennessee victims of slip-and-fall accidents that result from the negligence of a property owner may find comfort in knowing that, even if they are partially responsible, they are entitled to pursue recovery of financial damages.
