Tennessee residents who have to undergo medical procedures that involve anesthesia would naturally expect to receive adequate post-procedure treatment until the effects of the anesthesia have worn off. This was the case in an incident in another state in which a patient of an endoscopy facility suffered post-operative injuries. Court documents indicate that the plaintiff underwent a scheduled colonoscopy at the defendant's facility. She alleges negligence in her treatment after the procedure, claiming the defendant put her in a wheelchair as soon as she came to from the anesthesia.
Further allegations say hospital personnel rolled her to the hospital's rear exit and left her alone to wait for her ride. She claims she was instructed to ring the bell upon the arrival of the ride. However, the plaintiff says she was still groggy and went back to sleep, during which time she inexplicably fell out of the wheelchair and injured her head as well as her shoulder. The endoscopy facility faces accusations of negligence in its failure to provide proper care in the period after the medical procedure.
For legal expenses, mental anguish, pain, disfigurement, impairment, and lost wages -- all past and future -- the plaintiff claims over $1 million. Furthermore, she claims the defendant's acts were willful, malicious and grossly negligent, and she has asked for punitive damages to be added.
