Family settles before jury deliberates re medical malpractice

What price does a patient pay when a doctor fails to properly diagnose an adverse health condition? Some Tennessee families may relate to a deceased man's loved ones in another state who told the court their family member paid the ultimate price when he lost his life. The situation recently came to a conclusion when those who filed the medical malpractice lawsuit agreed to settle, just before the jury was charged.

The tragic situation began in 2007 when a man went to the doctor complaining of severe neck pain. In fact, when asked to rate his pain on a scale of one to 10, the man said his level of pain was a 10. He also mentioned feeling pins and needles sensations down his arm.

What followed was a series of injections and treatments ordered by the doctor to alleviate symptoms. The man was later diagnosed with cancer. He underwent surgery to remove a spinal tumor and received chemotherapy and radiation to treat the disease. Sadly, he did not survive. A medical malpractice lawsuit was filed on behalf of the decedent, blaming the doctor for his death.

The claim stated that the doctor's failure to diagnose the cancer cost the patient his life. The trial lasted six weeks and included third-party testimony from a diagnostic radiologist on behalf of the plaintiff. Family members agreed to accept a settlement for an undisclosed substantial sum. Medical malpractice situations like this one are often highly emotionally charged with loved ones desiring justice for the untimely deaths of their beloved family members. An experienced Tennessee personal injury attorney can aggressively pursue such a cause in court.
