Woman blames hospital for medical malpractice after surgery

A 73-year-old woman learned she had a slow-growing tumor inside her brain. The tumor was tested and found to be non-cancerous. In fact, most doctors say this type of tumor doesn't need to be surgically removed; instead, patients can simply be monitored as time goes on. As it might in Tennessee, this particular situation has led to a medical malpractice lawsuit.

The woman's case did not unfold as would typically be expected. Her doctor said she needed surgery and she complied. About four weeks later, the incision at her surgical site began to leak, and the woman suffered an infection. Instead of removing the mesh that had been inserted during surgery as is deemed appropriate treatment for such infections, the doctor merely prescribed antibiotics.

Some time later, the woman reported daily headaches and finally surgery was performed to remove the mesh. However, by that time, the mesh had attached to membrane inside the woman's brain, causing a severe loss of blood and a stroke when the surgeon tried to remove it. The woman suffered severe cognitive damage due to the stroke.

She has since filed a medical malpractice lawsuit, claiming $6 million in damages. Similar medical tragedies have occurred in Tennessee. In all situations, it's typically best to hire legal representation to advocate on one's behalf during court proceedings since malpractice claims are generally quite challenging to prove in court. An attorney can gather needed evidence and enlist the help of third party testimonies that can be used to help substantiate the claim by confirming the cause and severity of the injury.
