When a member of the public is injured on Tennessee property due to the owner or manager's fault or negligence, the question of who is responsible isn't always clear-cut. For instance, if businesses hire management or maintenance companies to maintain their premises and then slip\-and\-fall accidents occur anyway, several parties may be liable for injuries incurred. Premises liability can be very complex with varying levels of responsibility, and the guidance of an experienced attorney is often beneficial in such cases.
A recent incident in another state may be a good example. A man has filed a lawsuit alleging that the combined negligence of both a Wawa franchise and its on-premises maintenance company resulted in an accident that left him seriously injured. The lawsuit names as defendants both Wawa, Inc. and K&S Greenday Services, Inc.
According to the complaint, Wawa, Inc. had contracted K&S to provide snow and ice removal services for the property. However, the official complaint claims that, in Jan. 2016, due to the alleged collective negligence of the defendants, the plaintiff was injured by black ice, dangerous conditions that the defendants permitted to exist. This negligence allegedly resulted in, among other injuries, a traumatic rotator cuff tear and a supraspinatus tear of right shoulder, as well as subscapularis tears.
The plaintiff claims that the permanent damages he suffered resulted in not just pain, but lasting difficulties with his right shoulder movement and function. For the defendants' alleged negligence, the plaintiff seeks a judgment for damages in excess of $50,000. In cases similar to this one in Tennessee, it is not unusual for victims of slip-and-fall accidents to need ongoing medical care to treat the resulting injuries, and such medical care is typically costly. Thankfully, there are professional legal resources available to those who may need guidance and support in pursuing the justice and compensation they need and deserve.
