Businesses sometimes liable for slip-and-fall accidents outside

While Tennessee property owners are responsible for maintaining safe premises for customers, they are not necessarily liable for injuries that occur due to a fall on a public sidewalk. However, when dangerous conditions cause slip\-and\-fall accidents on sidewalks or private walkways used exclusively by customers entering and exiting a business, that is a different case altogether. In another state, for example, a woman is suing a hair salon after being injured on the walk outside the building.

The plaintiff visited the hair salon and was leaving when the alleged incident took place. According to the lawsuit, she had exited the building when the raised and uneven sidewalk outside caused her to fall. As a result, she suffered a number of serious and permanent personal bodily injuries, per the complaint.

The suit claims that her injuries include bilateral fractures of her patella, of which the right is serious enough to require surgery. Further surgeries were required – and more will be needed – for a right distal radius fracture. Additionally, the complaint lists jaw contusion and bruising, bilateral wrist pain with swelling, deformity and loss of range in motion to the victim's right wrist, and pain in both knees with deformity, swelling and scrapes on the right.

In addition to other charges, the lawsuit claims that the defendant failed to ensure the salon's premises were free of hazards and failed to repair the dangerously uneven and raised sidewalk. This negligence allegedly exposed the injured victim to an unreasonable risk of bodily harm, and for this, the plaintiff is requesting damages to the applicable arbitration limits. Victims of slip-and-fall accidents in Tennessee often similarly suffer serious and lasting injuries themselves, and they also have to deal with medical costs for necessary treatments. Sometimes, a successfully litigated personal injury lawsuit is the only means injured parties have of securing the funds to pay for the resulting medical care they need.
